Terms of Service

Welcome to MyExpense. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", or "User") and My Expense (PTY) Ltd ("MyExpense", "we", "us", or "our"), a company registered in the Republic of South Africa, governing your access to and use of the MyExpense website at myexpense.co.za, mobile application, and related services (collectively, the "Service").

Please read these Terms carefully before using the Service. By accessing or using MyExpense, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Acceptance of Terms

By creating an account, joining our waitlist, or otherwise using the Service, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement. You acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, which is incorporated herein by reference.

These Terms are governed by and must be interpreted in accordance with the Electronic Communications and Transactions Act, 2002 (ECT Act), the Consumer Protection Act, 2008 (CPA), and other applicable South African legislation.

2. Description of Service

MyExpense is an expense tracking and tax categorisation application designed for South African freelancers, sole proprietors, and small business owners. The Service provides the following features:

  • Expense tracking - Record and categorise your business expenses in one place
  • SARS ITR12 categorisation - Automatically map expenses to the correct SARS income tax return categories to simplify your annual filing
  • Receipt scanning - Capture and store digital copies of receipts using your device's camera
  • Mileage tracking - Log business-related travel and calculate claimable distances in accordance with SARS rates
  • Reports and exports - Generate summaries and export data to assist with tax preparation

We may add, modify, or discontinue features of the Service at any time. We will endeavour to notify you of material changes that affect your use of the Service.

3. Waitlist and Early Access

MyExpense is currently available via a waitlist. By joining the waitlist, you are expressing interest in the Service and will be notified when access becomes available.

  • The first 500 users to join the waitlist and activate their accounts will receive 3 months of free access to the full Service.
  • After the early access period of 3 months, or for users who join after the first 500 places have been filled, the standard subscription fee of R99 per month will apply.
  • We reserve the right to modify the waitlist programme, including the number of free places and the duration of the free access period, at our discretion. Any changes will not affect users who have already secured their early access benefit.

Joining the waitlist does not guarantee access to the Service and does not create an obligation for you to subscribe.

4. User Accounts and Responsibilities

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials, including your password
  • All activities that occur under your account, whether or not authorised by you
  • Notifying us immediately at hello@myexpense.co.za if you suspect any unauthorised access to or use of your account
  • Ensuring that the information you provide is accurate, current, and complete
  • Keeping your account information up to date

You may not share your account with any other person or allow others to access the Service using your credentials. We reserve the right to suspend or terminate accounts that we reasonably believe are being shared or misused.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

  • Use the Service for any fraudulent, illegal, or unauthorised purpose
  • Submit false, misleading, or fabricated expense data or receipts
  • Attempt to gain unauthorised access to any part of the Service, other user accounts, or our systems and networks
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to transmit any malicious code, viruses, or harmful content
  • Scrape, mine, or extract data from the Service by automated means without our written consent
  • Resell, redistribute, or sublicense access to the Service

We reserve the right to investigate and take appropriate action, including suspension or termination of your account, if we determine that you have violated these Terms.

6. Intellectual Property

All content, features, and functionality of the Service, including but not limited to the software, design, text, graphics, logos, icons, and trademarks, are the exclusive property of My Expense (PTY) Ltd or its licensors and are protected by South African and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal or internal business purposes, subject to these Terms. This licence does not permit you to:

  • Copy, modify, or create derivative works based on the Service
  • Use our trademarks, logos, or branding without prior written permission
  • Remove or alter any proprietary notices or labels on the Service

You retain ownership of the data you submit to the Service, including your expense records, receipts, and financial information. By using the Service, you grant us a limited licence to process, store, and display your data solely for the purpose of providing the Service to you.

7. Disclaimer and Limitation of Liability

Not a Tax Advisory Service

MyExpense is a software tool designed to assist you with expense tracking and tax categorisation. MyExpense is not a registered tax practitioner, financial adviser, or accounting firm. The Service does not constitute tax, financial, or legal advice.

While MyExpense maps expenses to SARS ITR12 categories based on publicly available guidelines, we do not guarantee the accuracy, completeness, or suitability of any categorisation for your specific tax situation. You are solely responsible for:

  • Verifying the accuracy of all expense data and categorisations before submitting any tax return to SARS
  • Consulting a qualified tax practitioner or accountant for professional tax advice
  • The accuracy and completeness of any tax return or submission you file with SARS

Limitation of Liability

To the maximum extent permitted by applicable South African law, including the Consumer Protection Act:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
  • My Expense (PTY) Ltd, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
  • Our total aggregate liability for any claims arising out of or related to the Service shall not exceed the total fees paid by you to us in the twelve (12) months preceding the claim.
  • We are not liable for any penalties, interest, or adverse outcomes resulting from SARS assessments, audits, or submissions based on data from the Service.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under South African law.

8. Payment Terms

The Service is offered on a monthly subscription basis at a fee of R99 per month (inclusive of VAT where applicable).

  • Early access users (first 500 waitlist members) will not be charged during their 3-month free access period. After this period, the standard monthly fee will apply unless you cancel your subscription.
  • Subscription fees are billed monthly in advance. Payment is due at the start of each billing cycle.
  • We accept payment methods as specified on the Service. All payments are processed in South African Rand (ZAR).
  • If a payment fails, we may suspend your access to the Service until the outstanding amount is settled.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing cycle, and no refund will be issued for the remaining period of that cycle.

We reserve the right to change our subscription fees with at least 30 days' prior notice. Continued use of the Service after a price change constitutes acceptance of the new fee. In accordance with the Consumer Protection Act, you have the right to cancel your subscription if you do not agree with the revised pricing.

9. Termination

You may terminate your account at any time by contacting us at hello@myexpense.co.za or through the account settings within the Service.

We may suspend or terminate your access to the Service, without prior notice or liability, if:

  • You breach any provision of these Terms
  • You engage in conduct that we reasonably determine is harmful to other users, the Service, or our business
  • We are required to do so by law or regulation
  • We discontinue the Service or any material part of it

Upon termination, your right to use the Service ceases immediately. We will retain your data for a reasonable period to allow you to export it, after which it will be securely deleted in accordance with our Privacy Policy. Any provisions of these Terms that by their nature should survive termination shall remain in effect.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

These Terms are subject to the provisions of the Consumer Protection Act, 2008 (Act 68 of 2008), and the Electronic Communications and Transactions Act, 2002 (Act 25 of 2002), to the extent applicable. In the event of any conflict between these Terms and the provisions of the CPA or the ECT Act, the relevant statutory provisions shall prevail.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page
  • Notify registered users via email at least 20 business days before the changes take effect, as required by the ECT Act
  • Provide a summary of the key changes

Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may cancel your subscription.
